Second Department Reduces Sex Offender’s Risk Level Assessment

Jordan Marsh, who had pled guilty to statutory rape in New Hampshire, was initially ruled to be a Level Two sex offender. In a 3-1 decision, the Appellate Division, Second Department, ruled that he was incorrectly assessed points for substance abuse and granted a downward departure to Level One, the lowest level.
