Reversal: Ineffective Assistance of Counsel and Prosecutorial Misconduct
December 18, 2013| By : Denise Corsi
The Second Department reversed the conviction of Appellate Advocates client Naasir Mehmood, concluding that he was deprived of his right to effective assistance of counsel because his attorney elicited “highly damaging testimony.” His attorney also failed to object to the prosecutor’s summation, even though the summation was so problematic that the court found it denied the Mr. Mehmood a fair trial. Mr. Mehmood’s case was sent back to the trial court for a new trial.
Denise Corsi briefed and argued the case.
