New Trial Ordered in Manslaughter Case

Appellate Advocates client Rodwell Austin was convicted of manslaughter in the first degree in 2010. On appeal, Appellate Advocates argued that the trial court committed reversible error when it declined to instruct the jury regarding the circumstances under which a person is justified in using deadly physical force against another. The Appellate Division, Second Department, agreed, reversing Mr. Austin's conviction and ordering a new trial.
