Court of Appeals Leave Grants

Leave Granted By Dissenter in Case About Spectators' Tee-Shirts


On December 24, 2014, the Appellate Division, Second Department, affirmed Joel Nelson's conviction of second-degree murder and first-degree assault, holding that the fact that members of the decedent's family wore memorial tee-shirts during the trial did not deprive Mr. Nelson of a fair trial.  Judge Dickerson, who dissented in the case, granted leave to appeal on March 27, 2015.  

Alexis Ascher briefed the case in the Appellate Division and will continue to represent Mr. Nelson in the Court of Appeals.
