Double Jeopardy Brief Filed in Second Circuit

On March 15, 2015, Skip Laisure filed a brief in the Second Circuit appealing the denial of a habeas corpus petition that Appellate Advocates had submitted on behalf of our client Rameen Smith.  Mr. Smith had already finished serving his 11-year determinate sentence (and he remained incarcerated only on later-imposed consecutive sentences “aggregated” by DOCCS) when he was resentenced to a 5-year term of post-release supervision ("PRS").  Mr. Laisure's brief argues that the PRS resentencing violated Mr. Smith's federal double jeopardy rights.
