Dissenting Justice Grants Leave to Appeal

Michael Johnson was convicted at trial of attempted murder and related counts based in part on inculpatory statements he made to law enforcement during a 33-hour interrogation. In a decision dated May 18, 2016, the Appellate Division, Second Department, affirmed Mr. Johnson’s conviction over the dissent of Justice Hall, who would have suppressed Mr. Johnson’s statements to law enforcement as involuntarily made, and ruled that cumulative errors deprived him of a fair trial.
By order dated August 5, 2016, Justice Hall granted leave to appeal to the Court of Appeals.
De Nice Powell briefed and argued the case in the Second Department, filed the leave application, and will continue to represent Mr. Johnson in the Court of Appeals.
