Court of Appeals Orders New Trial Because of Brady Error
The People objected to the defendant’s pre-trial request for the direct disclosure of the contact information of two favorable witnesses. Instead, the People offered to give defense counsel's contact information to the witnesses. Holding that the People's refusal to provide defense counsel with a way to contact the witnesses directly was "tantamount to suppression of the requested information," the Court of Appeals reversed the defendant's conviction and ordered a new trial.
