Case Remanded for Youthful Offender Consideration

Appellant, Eric P., pled guilty to second degree robbery, petit larceny, and second-degree assault after being charged under two indictments. When sentencing appellant on his conviction under one of the indictments, the court "stated that the defendant was not being afforded youthful offender status," but "did not place on the record any reason" as to why.
On appeal, the Appellate Division, Second Department, vacated appellant's sentence and remanded the case for a determination regarding whether the defendant should be afforded youthful offender treatment.
