Appellate Division Vacates Conviction for First-Degree Assault


Mr. Frazier was charged with first-degree assault and related crimes, stemming from an August 2008 shoot-out on a Brooklyn street. 

The Appellate Division vacated Mr. Frazier’s conviction for first-degree assault because the evidence was not legally sufficient to establish that he, as opposed to another person at the scene, caused the injury to a child struck in the cross-fire.
